Contract for the Supply of Products or Services

The products, prices and services illustrated on our website do not constitute a legally binding offer. No contract for the supply of products or goods will be deemed to exist between you and Brumers Bikes unless, and until full payment has been made and the order accepted.

An acceptance email is automatically sent by Brumers Bikes to you confirming that your order has been accepted and payment has been successfully made. This confirmation e-mail amounts to an acceptance by Brumers Bikes of your offer to buy goods or services from Brumers Bikes and this acceptance is effective regardless of whether or not you receive the e-mail.

Brumers Bikes reserves the right to withdraw from a prospective contract at any time prior to or after acceptance. This also applies after a confirmation email has been sent in the case of any error or inaccuracy in respect of the goods or services, any description applied to the goods or services, the availability of the goods or services, or the order itself. Under these circumstances Brumers Bikes will notify you as soon as possible and the option to wait for stock, choose an alternative or a full refund will be offered.

Brumers Bikes will accept the cancellation of an order, in writing ( email, letter ) or on the return of the goods. The buyer has 14 days to return the item for a full refund. Your right to cancel an order for goods starts the moment you place your order and ends 14 days from the day you receive your goods. Please notify us immediately if you wish to cancel. If the item is found to be faulty you have 30 days from the purchase date to return for a full refund

Price and availability information is subject to change without notice. Credit cards are debited before items are shipped or before services are activated by Brumers Bikes. When a customer 'Checks Out' as a guest, a simple account is created and an email is sent with a password. This enables our customer to login and track their order, contact us and raise returns notes etc.
www.brumersbikes.co.uk is an Online business only, your item cannot be returned to us in person.  We do not have a Trade/Customer counter and your purchase cannot be returned to any of our shops.  Your item must be sent back to the address above.  Please do not turn up for assistance with an Online purchase as you will be turned away!  If you would like face to face service, please purchase directly from our retail shop.

Order Information : Card Security Checks

Brumers Bikes uses Secure Trading to process our Card Payments. Secure Tradingy use very stringent security checks to protect us and our customers from card fraud. On rare occasions an order is flagged as a 'Risk' by Secure Trading and Brumers Bikes must investigate further. This may be due to a number of reasons, but mainly it is because the card used is from a different country to the delivery address or the delivery address given is not known to Secure Trading or your bank. We will in these cases contact you and ask for additional information to be supplied - normally proof of address for the card used and proof that the card owner works at the delivery address. To avoid any problems if you are paying from abroad, we recommend you click 'Pay using PayPal' - a PayPal account is not required.

Paying for your product - Exchange Rates

If paying in a Currency other than GBP (£), there may be an exchange rate difference applied by your Bank or PayPal, after you have placed the order.  This is NOT applied by Brumers Bikes and may be more than the amount shown on our website.  Brumers Bikes is NOT responsible for this difference.  The Currency Rates shown on our website are automatically checked and updated regularly based on the latest Exchange Rates, but can of course be higher or lower.

Brumers Bikes is providing this site and its contents on an "as is" basis and makes no representations or warranties of any kind with respect to this site or its contents. Brumers Bikes disclaims all such representations and warranties, including for example warranties of merchantability and fitness for a particular purpose. All specifications, measurements and technical data have been prepared by manufacturers. Brumers Bikes does not represent or warrant that the information accessible via this site is accurate, complete or current.

Limitation of Liability

Except as specifically stated on this site, neither Brumers Bikes nor any of its directors, employees or other representatives will be liable for damages arising out of or in connection with the use of this site. This is a comprehensive limitation of liability that applies to all damages of any kind, including (without limitation) compensatory, direct, indirect or consequential damages, loss of data, income or profit, loss of or damage to property and claims of third parties.

Although Brumers Bikes try and use the correct images for each item, sometimes mistakes can happen and the wrong image may be uploaded. It is up to the customer to confirm in advance if there are any differences between images and descriptions. Due to manufacturer updates, screen definition differences etc, images can differ from the actual item supplied, Brumers Bikes are not responsible for any costs if this is the case.

Brumers Bikes do not accept liability for failure to supply caused by matters beyond the company’s reasonable control including but not exclusively strikes, civil disputes, acts of God, war or other third party actions.

Brumers Bikes is NOT responsible for exchange rate changes (at the time of placing the order or at the time of a refund), import duty or import tax to your Country. It is up to the customer to check any Duty that may be payable prior to placing the order. 

Delivery

Please see our Delivery page for detailed information by clicking here. Brumers Bikes cannot be held responsible for any taxes or any other charges your country may impose for importation of your order. Please await confirmation of despatch before pre-paying any VAT or taxes that may be due. Please contact your country's custom office to check if you are liable to incur importation charges.  We will not send an item as a gift/sample or reduce the value for Customs or VAT purposes. 

Brumers Bikes is not responsible for extended area delivery charges or errors in the online order shipping system. If an order is placed and shipping must be charged due to a system error, customer neglecting to select the correct option or additional charges due to remote locations, Brumers Bikes will contact the customer with shipping information and a price.  Delivery to the Canary Islands, Balearic Islands (Tenerife, Majorca etc) other Spanish Islands, Greek Islands etc is not free.  We will contact the customer to let them know of any additional amounts to pay.

Illegal Acts

It is a crime to use a false name or a known invalid credit card to order. Anyone caught wilfully entering an erroneous or fictitious order will be prosecuted to the fullest extent of the law. We track the electronic fingerprints of every order placed on this website to enable us and all legitimate crime prevention and prosecution authorities to trace individual users engaging in criminal activities on our website.

Changes in Terms

Brumers Bikes reserves the right to modify these terms at any time without prior notice. Any modification of these terms will be deemed to be effective from the date and time of posting on the brumersmotorcycleshop.com web site. Prices and special offers can change at any time, without notice and deals cannot be back-dated. 

Governing Law

These terms and conditions are governed in accordance with English law and the English and Welsh courts shall have jurisdiction to resolve any disputes.
